Privacy statement

Introduction 

This Privacy Policy applies to the processing of personal data of all our users in connection with the products and/or services of Studio Freek Merchandise B.V. This Privacy Policy describes how this data is processed and for what purposes it is processed. This Privacy Policy also contains information about our cookie policy. By using Studio Freek Merchandise’s products and/or services and agreeing to this Privacy Policy, the user agrees to the following terms and conditions that apply thereto.

Providing personal data is not mandatory 

At all times, a user has the choice whether or not to provide his/her personal data. However, in order to use some of our products and/or services, it is necessary to provide your personal data to Studio Freek Merchandise. If the input of your data is requested, Studio Freek Merchandise indicates which data are 'necessary' to be able to use the products and/or services and which data can be provided 'optionally'.

Processing of personal data 

By using the products and/or services of Studio Freek Merchandise, the company processes the personal data of its users. This includes:

• the name;
• address information;
• email address; and
• financial information, such as a bank account number, if a user purchases a paid product and/or service from Studio Freek Merchandise, provided that such information is necessary for the payment of the relevant products and/or services.

The processing of personal data takes place in the following cases:

1. for the conclusion and execution of an agreement concluded with the user;
2. For administrative processing: to offer and/or provide the user with the agreed products and/or services;
3. For billing purposes: this applies to one or more paid products and/or services. If payment for our products and/or services is not received, we may refer the claim to a third party, such as a collection agency

In the aforementioned cases, the name, address details, bank details and email address are necessary for the execution of the agreement.

1. to send targeted offers to the user or for other promotional purposes, for example via email if the user has indicated their consent. To this end, Studio Freek Merchandise collaborates with Studio Freek Fans B.V. and uses Meta Pixel and Google Analytics for this purpose.

In the aforementioned cases, personal data—specifically the email address—is provided on an optional basis, for which the user gives explicit consent. If Studio Freek Merchandise processes the relevant personal data based on consent, the user may withdraw that consent at any time by sending an email to webshop@freekvonk.nl. Studio Freek Merchandise will no longer process the personal data, unless there is (also) another legal basis for processing the personal data.

1. To administer, analyze, maintain, optimize and secure our products and/or services and to prevent misuse and/or fraud of products and/or services;

2. When a user visits one of our (mobile) websites, our servers may also (automatically) store information such as URLs, IP addresses, browser types, languages, and the dates and times of visits to our (mobile) websites and/or apps.

In the aforementioned cases, Studio Freek Merchandise has a legitimate interest in processing the personal data in question. Studio Freek Merchandise’s legitimate interest in processing personal data stems from its legitimate need to manage, analyze, maintain, optimize, and secure its products and services; to prepare strategic analyses and reports; and to prevent misuse and/or fraud. In addition, this interest includes the ability to monitor and improve the use of its (mobile) websites and applications, including through the processing of technical data such as IP addresses and usage information. These processing activities are necessary for the provision of a secure, efficient, and properly functioning service.

The personal data provided are processed by Studio Freek Merchandise exclusively for the purpose of implementing its products and/or services and in particular for the explicit purpose for which these personal data have been collected.

Personal data will only be kept for the period necessary for the proper execution of the aforementioned purposes. In case longer legal retention periods apply, the retention periods as prescribed by law will apply.

User Rights

All our users have the rights under the GDPR to manage their own personal data:

• The right to restrict processing.

Passing on third parties

Subject to the provisions below, only those individuals authorized by Studio Freek Merchandise to secure and/or otherwise process personal data and/or perform IT maintenance tasks have access to users’ personal data.

For the processing purposes listed in this Privacy Statement, we have engaged a processor with whom we have entered into an agreement, ensuring that the processor provides sufficient guarantees regarding technical and organizational security measures.

In the unlikely event that you discover a data breach, it is very important that you notify us immediately. You can report data breaches directly via: webshop@freekvonk.nl. Your report and details will be treated confidentially at all times.

Otherwise, Studio Freek Merchandise will not disclose its users’ personal data to third parties, unless this is necessary for the provision of its products and/or services pursuant to a legal requirement or, in an emergency, to the extent that Studio Freek Merchandise reasonably determines this is in the best interests of its users. This also includes lawful requests from authorities, subpoenas or court orders, actions to detect or prevent damage or fraud, or actions to ensure the security of our network and our products and/or services.

Studio Freek Merchandise has implemented appropriate technical and organizational measures to protect users’ personal data against loss or unauthorized processing, including (i) storing such data in a secure database with two-factor authentication and (ii) processing payment(s) to Studio Freek Merchandise via the Mollie payment system.
